
I have a question for all law-abiding citizens regarding right of way at a two-way stop. Almost daily I have to cross a very busy highway. The highway is north-south bound. The two-way stop is east-west. So here's the scenario: a blue car comes to the intersection heading west. It stops at the stop sign, signals left and then has to wait for a break in traffic. A minute later a white car stops at the the opposite stop sign (heading east) to wait for a break in traffic intending to go straight. Who has the right of way? The blue car who is first at the intersection, or the white car who is not turning.
I'm tired of the "courtesies" that result from people not knowing the law. That's how accidents happen. I have looked up the DMV manual. It does not describe this particular intersection headache. I thought I knew what the answer was. People have Googled this problem. There is no unanimous decision for who has the right of way. I have asked several people what they think. The feedback is not unanimous. Kind of scary when I think about staring down someone across the four lane highway and wondering which side of the rule they belong to. The problem isn't that drivers don't follow the rules; it's that they don't know them. Yikes.
And no--that is not a picture of an accident that I was involved in. thank goodness.

no matter what, that picture is very disturbing!
my choice is that the car that was there first has the right of way...itsn't that the way that it is? (well apparently not...or you wouldn't be having this dilemna!)

Kristy, it's just like I told you. Whoever gets there first has the right of way, unless you get there at the same time in which case, whoever is driving the blue car has the right of way, unless the white car is a mustang, in which case the blue car must yield, unless of course, there is an actual yield sign, in which case the blue car would have the right of way over the white mustang, unless it's thursday or wednesday evening, in which case the white and blue would need to yield to any black cars or perhaps Volvos with Missouri plates, unless of course, as we all know, the rain in spain stays mainly on the plain, in which case, the black, blue, white, and missouri volvos all need to yield to oncoming traffic unless there's a red light, which, in your which case, there is not, so, as we can plainly see, we need to support equal car rights and not be prejudiced between white and blue and black and missourians and just let everybody have their fair shair at driving on the road, unless of course, somebody complains to the local government and says that we need a stoplight.
I was a bit nrevous to see that picture, I was scanning very quickly to see if your blue van was in it!! Glad it wasn't you!! Don't you hate the driving thing...especially the courtesies!!! Hope you are doing well...see you soon???
Honestly, I don't know the answer either. I usually say whoever got there first but also err on the side of caution and make extra sure they are seeing me go before I do. Good question.
